  1. Act of April 16, 2020, on specific support instruments in connection with the spread of SARS-CoV-2 virus

The Committee to Reform Ownership Supervision took an active part in developing the second chapter of the relief scheme (Act of April 16, 2020, on specific support instruments in connection with the spread of SARS-CoV-2 virus). Expert groups explored the issue that proved problematic in face of the economic recession in direct result of the Covid-19 pandemic, which was Article 21.1 of the Bankruptcy Law of February 28, 2003, obliging the debtor to file a bankruptcy petition within 30 days after the state of insolvency occurred. Under these provisions, in the event of failure to comply with this obligation, the manager could be liable with private property for damages incurred as a result of the postponed bankruptcy. The provision weakened the competitiveness of Polish businesses once compared to those abroad as other countries introduced legal solutions to protect domestic businesses from Covid-19 bankruptcy.
